These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," "your") and Burke Labs LLC, a Delaware limited liability company (registration pending) ("Burke Labs," "we," "us," "our"), governing your access to and use of the LeadLifeline platform, website, and related services (collectively, the "Service").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.
LeadLifeline is a software-as-a-service platform that enables home service businesses to:
The Service is provided "as-is" and we continuously develop and improve it. Features may be added, modified, or removed with reasonable notice.
You must be at least 18 years old and legally capable of entering into a binding agreement. The Service is intended for business use only.
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must notify us immediately at daire@leadlifeline.io if you suspect unauthorised access.
You agree to provide accurate, current, and complete information during registration and to keep it updated.
The Service is offered as a monthly subscription. As of the effective date, pricing is:

Prices are subject to change with 30 days' written notice.
Subscriptions are billed monthly in advance through our payment provider (LemonSqueezy or Stripe). LemonSqueezy acts as the merchant of record and handles applicable VAT, GST, and sales tax. By subscribing, you authorise recurring charges to your chosen payment method.
New subscribers are entitled to a 14-day money-back guarantee from the date of their first payment. If you are unsatisfied for any reason, contact us at daire@leadlifeline.io within 14 days of your first charge for a full refund. This guarantee applies to the first payment only.
You may cancel your subscription at any time through the platform or by emailing daire@leadlifeline.io. Upon cancellation:
After the 14-day money-back guarantee period, payments are non-refundable. If a payment fails, we will attempt to charge your payment method again and may suspend your account if payment remains unsuccessful.
We reserve the right to suspend or terminate your account if we reasonably determine you are violating these Terms. Where possible, we will provide notice and an opportunity to remedy the violation before termination.
You retain all ownership rights to the data, content, and materials you upload to or create within the Service ("Your Content"). We do not claim ownership of Your Content.
You grant Burke Labs LLC a limited, non-exclusive, worldwide licence to host, store, process, and transmit Your Content solely for the purpose of providing the Service. This licence terminates when you delete Your Content or your account is closed.
You are the data controller for your End Contacts' personal information. You are responsible for having a lawful basis to collect, store, and contact End Contacts, responding to their data requests, ensuring data accuracy, and complying with all applicable data protection laws. We act as a data processor on your behalf.
You may export your data at any time. Upon cancellation, we permanently delete Your Content within 90 days, except where retention is required by law.
The Service, including its design, code, features, branding, and underlying technology, is owned by Burke Labs LLC. These Terms do not transfer any ownership rights to you.
"LeadLifeline," "Burke Labs," and associated logos are trademarks of Burke Labs LLC. If you provide suggestions or feedback about the Service, we may use that feedback without obligation or compensation.
The Service integrates with Supabase, Resend, Cloudflare, Google Gemini API, and LemonSqueezy/Stripe. Your use of these services is subject to their respective terms. We are not responsible for the availability or practices of third-party services.
Emails are sent from our verified domain (hello@send.leadlifeline.io) via Resend. The sender name displays as your business name and owner name. We maintain sending reputation by enforcing compliance standards, but we do not guarantee deliverability to any specific inbox provider.
You are solely responsible for the content of emails sent through the Service. Sending harmful, illegal, or non-compliant content may result in immediate suspension.
We strive to maintain high availability but do not guarantee uninterrupted access. Support is available via email at daire@leadlifeline.io. We aim to respond within one business day.
To the maximum extent permitted by law, Burke Labs LLC's total aggregate liability shall not exceed the lesser of the total fees you paid in the 3 months preceding the claim, or $500 USD.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of data, or damage to business reputation.
If you are a consumer under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), nothing in these Terms excludes any consumer guarantee that cannot be excluded under that law. To the extent our liability cannot be excluded, it is limited to resupplying the Service or paying the cost of having the Service resupplied.
You agree to indemnify and hold harmless Burke Labs LLC from any claims arising out of your use of the Service, your violation of these Terms or applicable law, your End Contact data and campaign content, or any third-party claim related to your use of the Service.
These Terms are governed by the laws of the State of Delaware, United States. Before filing any formal claim, you agree to contact us at daire@leadlifeline.io and attempt informal resolution for at least 30 days.
If informal resolution fails, disputes shall be resolved in the courts of Delaware. If you are located in Australia, nothing in this section limits your right to bring proceedings in an Australian court if required by Australian law.
You may terminate your account at any time. We may suspend or terminate your account if you breach these Terms, fail to pay after reasonable notice, or if your use poses a risk to others. We may discontinue the Service with 60 days' notice and a pro-rata refund.
Upon termination, your right to use the Service ceases immediately. Sections on ownership, warranties, liability, indemnification, and disputes survive termination.
These Terms and our Privacy Policy constitute the entire agreement. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without consent. We are not liable for failures caused by circumstances beyond our reasonable control.
